Terms of Service

1. Nature of the Service

1.1. Venue Only.

SwapStride is a subscription-based online community that allows users to list and browse running equipment (primarily shoes). We act exclusively as a venue. We are not a party to any transaction between buyers and sellers, nor do we handle payments, shipping, or the exchange of goods.

1.2. No Agency.

No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.

2. Eligibility and Accounts

2.1. Age Requirement.

The Service is available only to individuals who are at least 18 years old. By using the Service, you represent and warrant that you are of legal age to form a binding contract.

2.2. Geographic Scope.

The Service is currently intended for use by residents of Europe.

2.3. Account Security.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions and Payments

3.1. Subscription Fees.

Access to the Service requires a paid subscription ("Membership"). Prices and billing cycles (e.g., annual, monthly) are displayed at checkout.

3.2. Auto-Renewal.

Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the renewal date. You authorize us (via our payment processor, Stripe) to charge the applicable fee to your payment method.

3.3. Right of Withdrawal (Diritto di Recesso).

In accordance with EU Consumer Law, you have the right to withdraw from this contract within 14 days of the initial purchase without giving any reason. To exercise this right, you must contact us at info@swapstride.com.

If you withdraw within 14 days, we will refund the full amount.

Exception: If you explicitly requested to begin using the service immediately (e.g., by contacting a seller or listing an item) during the withdrawal period, you may be liable for a prorated amount or forfeit the right of withdrawal depending on specific usage, but generally, we honor the 14-day window.

3.4. Refund Policy.

After the 14-day cooling-off period has expired, payments are non-refundable. We do not offer refunds for partially used subscription periods.

4. Marketplace Rules and Conduct

4.1. Prohibited Items.

You may only list authentic running-related equipment (shoes, apparel, watches). The following are strictly prohibited:

• Counterfeit or "replica" goods.
• Stolen items.
• Non-running items (e.g., casual sneakers, electronics not related to sport).
• Dirty or unsanitary items.

4.2. Prohibited Conduct.

You agree not to:

• Use the Service for any illegal purpose.
• Harass, threaten, or defraud other users.
• Post false or misleading information.

4.3. Content License.

By posting content (e.g., photos of your shoes) on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content for the purpose of operating and marketing the Service (e.g., sharing a "Listing of the Week" on our social media).

4.4. Termination.

We reserve the right to suspend or terminate your account at our sole discretion if we receive reports of violations (e.g., selling fakes, harassment) or for any breach of these Terms.

5. Disclaimers and Release

5.1. "As-Is" Service.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not verify the accuracy of listings, the quality of items, or the identity of users.

5.2. No Liability for Transactions.

You are solely responsible for your interactions with other users. We adhere to a "Caveat Emptor" (Buyer Beware) policy. We are not liable for:

• Items not received or damaged during shipping.
• Items that do not fit or match the description.
• Payment disputes (since we do not process payments).

5.3. Safety Release.

You acknowledge that meeting strangers or exchanging addresses carries inherent risks. You agree to take all necessary precautions and release Hannes Vieider (d.b.a. SwapStride) from any claims, demands, or damages arising out of disputes with other users.

6. Limitation of Liability

To the maximum extent permitted by Italian law, Hannes Vieider and SwapStride shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

(a) your access to or use of or inability to access or use the Service;

(b) any conduct or content of any third party on the Service.

7. Governing Law and Jurisdiction

7.1. Governing Law.

These Terms shall be governed by and construed in accordance with the laws of Italy.

7.2. Jurisdiction (Foro Competente).

Any dispute arising from or relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the Court of Bolzano (Tribunale di Bolzano).
